Medical Professionals
When a doctor, dentist, podiatrist, chiropractor or other health professional sues for divorce, or is sued for divorce by his or her spouse, serious issues of patient confidentiality arise. An experienced matrimonial attorney can usually resolve the conflicting claims and the conflicting considerations in such matters between full and complete financial disclosure on the one hand and the need for patient confidentiality on the other. This is why medical professionals should always use an attorney who devotes his practice exclusively to Divorce and Family Law matters, not a “jack of all trades” general practice attorney. In addition, it is important that the divorce attorney also have substantial Trial Court experience in case the matter cannot be resolved and must go to trial. Lastly, the divorce attorney should have years of experience handling substantial divorce matters, including successful professional practices. Our firm has represented many professionals over the past 30 years, including medical doctors with specialities ranging from oncologists, radiologists, internists, psychiatrists, dermatologists, pediatricians, etc. We have also represented dentists, podiatrists, and chiropractors. In addition, if there are allegations being made against the health care professional that he or she is guilty of domestic violence, special attention must be paid to those allegations because it could jeopardize the doctor’s ability to keep his or her medical license. The “bottom line” is that a medical professional and the spouse of a medical professional should only use the most experienced divorce attorneys that they can find! We suggest that you only use an attorney that devotes his or her practice exclusively to divorce and family law matters, and who preferably has at least 20 years of experience, including substantial trial experience. Our experience has shown that where settlement negotiations are entered into early and before bitter acrimonious Court litigation occurs, that there can frequently be an excellent chance of settling the divorce on terms that are fair to both the health professional and the spouse, and without the need to spend many tens of thousands of dollars in divorce lawyers fees. Because we believe that settlement negotiations rather than immediate Court litigation, can frequently be beneficial to our clients, we generally encourage prospective clients to consider hiring our firm to attempt to negotiate an out of Court settlement. While some firms in Manhattan will require an up front retainer of $20,000.00 to $50,000.00 even before suit is filed, our firm only charges a $3,000.00 retainer if the matter is not yet in litigation. Obviously, if the matter already is in litigation, or we believe in our professional opinion that divorce litigation must be commenced immediately, the up front retainer will be substantially higher. Our firm offers an initial 30 minute confidential initial consultation with Mr. Leininger for only $100.00. During that initial consultation, Mr. Leininger will answer all your questions and will give you the plain truth. He will also explain the legal issues involved in plain everyday English. At that point, he will suggest that you go home and think over whether you wish to retain our firm. We never pressure people who come in for an initial consultation to decide immediately whether they wish to retain our law firm. To the contrary, we urge people to go home and think about it, pray about it, talk to their relatives and friends and trusted advisors, etc., and only when they are sure that they wish to retain our firm do we recommend that you hire our firm. Should you retain our firm within 30 days of that initial consultation, we will even credit you for the $100.00 initial consultation fee on your first monthly invoice.
